AG will not appear for Acting IGP in Pilapitiya’s writ

Attorney General (AG) Dappula de Livera has informed the Acting IGP C. D. Wickremeratne that he cannot appear for him in the Writ Application filed by interdicted Former Embilipitiya High Court Judge Gihan Pilapitiya in view of his failure to comply with AG’s advise previously. Judge Pilapitiya was interdicted in January this year over a controversial telephone conversation he had with former United National Party (UNP) MP Ranjan Ramanayake. The AG had earlier instructed the Director of the Colombo Crime Division (CCD) to obtain a warrant and arrest interdicted Judge Pilapitiya and produce him before court. The AG directed the CCD to arrest Pilapitiya for conspiring to fabricate false evidence along with MP Ranjan Ramanayake. However, Wikramarathne had instead appointed a five-member committee to study the instructions issued by the AG. Following Wikramarathne’s response, the AG had accused Wickramaratne of a possible violation of the Constitution by not adhering to his instructions with regard to Judge Pilapitiya. The AG has also expressed his displeasure over the Act. IGP’s response in dealing with AG’s advice. In a letter sent to the Acting IGP, Wickramaratne had been cautioned that he may have violated Articles 12 (1) and 12 (2) of the Constitution by failing to adhere to the instructions to obtain a warrant and arrest Judge Pilapitiya. In the letter, the AG had also  demanded an explanation from Wickramaratne for failing to adhere to his advice on the interdicted High Court judge.
