Appeal Court hears revision application filed against HC’s refusal to grant bail to Shani Abeysekara

29 Apr 2021

The revision application filed against the High Court refusal to grant bail to former Director, CID Shani Abeysekara was taken up today (April 29) in the Appeal Court. ASG Rohantha Abeysooriya with DSG Shanil Kularatne informed Appeal Court judges Bandula Karunaratne and R. Gurusinghe that the state wanted one more week to consider the matter. Viran Corea with Thilini Vidanagamage instructed by Gowry Thavarasha appearing for Abeysekara urged that the situation is very unsatisfactory, as the case was being taken up for the respondents to file any objections for which ample time had been given, and that he was not in a position to accommodate further attempts to delay determination of the matter. He urged that Abeysekara (who has health issues) was being irresponsibly placed in grave danger especially in view of Covid-19 and that it is the responsibility of all concerned not to unnecessarily delay the matter. Therefore, he urged the court to have the case fixed for inquiry and decision on a very early date as a matter of high priority. The court heard submissions of all counsel and directed that the case should be taken up for inquiry on 13th May and permitted the AG to file any objections by 7th May, serving a copy on the petitioner's instructing attorney.
