Ex-ASG absconding?

08 Sep 2019

By The Sunday Morning News Desk One of the highest ranking legal officers in the country is allegedly absconding the Police Criminal Investigation Department (CID) after investigators obtained a court order last Thursday (5) to record a statement over the high-profile case on the disappearance of 11 youth some time around 2009, The Sunday Morning learnt. It is learnt that the Attorney-at-Law of the aggrieved party, Achala Senevirathna, had made an application under Section 124 of the Code of Criminal Procedure (CPC) when the case was called up the previous day (4) to compel former Assistant Solicitor General (ASG) Shavindra Fernando PC to give a statement. The Sunday Morning learnt that the CID visited the residence of Fernando last evening (7) but was unable to locate the ex-ASG. When the case was called up on 21 August, lawyers for Fernando informed court that the Sri Lanka Navy had not wanted Fernando to divulge information, citing ethics of confidentiality and attorney-client privilege. Fernando had failed to give his statement to the CID on five previous occasions after former Sri Lanka Navy Commander then Admiral Wasantha Karannagoda told the investigators that once he got to know of rogue elements in the Navy back in 2009, he at once directed Fernando, who was heading the legal division in the Navy, to take immediate action.
