The President, Vice President and Secretary of the United National Society of Self-Employed have filed a Fundamental Rights Application before the Supreme Court against the move to open liquor stores during the ongoing quarantine curfew.
Accordingly, the petitioners seek an interim order directed to the authorities so that the opening of liquor stores will be prevented
The application notes that the opening of liquor stores is a violation under certain laws of the Quarantine and Prevention of Diseases Ordinance. Despite this, the petitioners claim that Sri Lanka Police and the Department of Excise have not acted in a manner which upholds the law of the country.
During Court proceedings today, Counsel Eraj De Silva, who appeared for the petitioners, pointed out that this move is in violation of Article 12(1) of the Constitution. He further urged the Court to expeditiously put forward the interim orders as it is a matter of national interest.
In response to this, the State Counsel appearing for the Attorney General stated that such submissions cannot be made today as instructions from the Respondents have not been received on the matter so far.
The Director General of Health Services, Inspector General of Police, Commissioner General of Excise Department, Minister of Health Service, Attorney General and 42 others who are members of the Presidential Special Task Force to Prevent Covid have been named as respondents.
The next hearing on the same will take place on October 04.
