New CJ: CC yet to receive nominations

16 Apr 2019

The Constitutional Council (CC) was yet to receive nominations for the appointment of the next Chief Justice from President Maithripala Sirisena, according to a CC member who wished to remain anonymous. He told The Sunday Morning that as at 6 April, the Council had not received any name to consider. However, the Council will next meet at the end of this month and by that time, he said the President might send his recommendations. The present Chief Justice Nalin Perera will retire on 29 April. On 12 October last year, Perera became the 46th Chief Justice of Sri Lanka and gave one of the most significant court verdicts in the history of the judiciary of Sri Lanka. “We haven’t received nominations yet. We had a meeting on Friday. The meeting was fixed about two weeks ago. We meet routinely every two weeks. This was fixed on Friday and no nominations came. We’re next going to meet at the end of April,” he said. “It is only after the retirement of CJ Perera that the need for an appointment arises. So far, he has not sent any nominations. I don’t think there will be a problem. The courts are on vacation and the Supreme Court is sitting on 29 April after the vacation. By that time, the President will send nominations and if necessary, we will meet earlier than the at end of this month,” he said. In accordance with the 19th Amendment, the prerogative is with the President to make nominations.
