Rishad files FR petition to prevent arrest over Easter bombings

Former Minister and the Leader of the All Ceylon Muslim Congress Rishad Bathiudeen has filed an FR petition before the Supreme Court requesting the Court to grant an interim order preventing him from being arresting by the Criminal Investigation Department (CID) over the the bombings that occurred on the 21 st of April 2019. CID Officer in Charge, Special Investigation Unit – III, Ravindra Wimalasiri, CID Officer in Charge,  CID Director, CID Deputy Inspector General Nuwan Wedasinghe,  Acting Inspector General of Police C.D. Wickramaratna,  and the Attorney General have been named as respondants in the petition. The Petitioner makes this application in respect of the imminent illegal arrest and/or imminent illegal detention of the Petitioner which constitute a violation or imminent violation of the Fundamental Rights guaranteed to the Petitioner by Articles 12 (1), 12 (2), 13 (1), 13(2) and 14 (1) (f) of the Constitution. The Petitioner states that at no point in time has the Petitioner engaged in and/or aided and abetted in any activity that culminated in the Easter Sunday Bomb Attacks. The Petitioner states that he has not committed any act which would constitute an offence under the provisions of the Prevention of Terrorism Act, and or any other Law and in such circumstances the continued harassment of the Petitioner by the respondents are a grave violation of his fundamental rights. The Petitioner further states that these baseless investigations have already been the subject of a media frenzy where the Petitioner and his family has already been the subject of harassment. Further, the Petitioner states that these allegations made by the media as a result of baseless investigations by the respondents have caused severe detriment to the Petitioner’s political image. The Petitioner has requested the SC to grant an interim order restraining the CID from arresting the Petitioner on an allegation of having committed any offence relating to, or arising out of, the bombings that occurred on the 21 st of April 2019 or any other alleged terrorist activity, until the final determination of this application.
