Sathkumara denied bail

06 May 2019

Award-winning author and poet Shakthika Sathkumara has been denied bail and further remanded, the Police said. A spokesman at the Police Media Division told The Sunday Morning that Sathkumara has been remanded till 7 May 2019 by the Polgahawela Magistrate’s Court. Sathkumara was arrested after the publication of his short story “Ardha” in which he brings to life a character that relinquished his yellow robes and discovered his homosexuality. The short story infuriated a group of the Buddhist clergy who demanded Sathkumara’s arrest. He was initially charged under Section 292 of the Penal Code of Sri Lanka for trespassing and causing religious disharmony. However, when he was presented in court on 1 April, he was charged under the ICCPR Act of 2007 Section 3(1), which prohibits propagation of war, racial advocacy, and racial or religious hatred that would incite discrimination, hostility, or violence. Asian Forum for Human Rights and Development (FORUM ASIA) issued a statement saying Sathkumara’s arrest was directly in violation of the ICCPR Act itself which “guarantees everyone’s right to freedom of expression”.
