SC grants leave to proceed with case against PTA Deradicalisation Regulations

The Supreme Court of Sri Lanka today (26) granted leave to proceed with the case against the De-radicalisation Regulations that come under the Prevention of Terrorism (Temporary Provisions) Act, No. 48 of 1979 (PTA), under Articles 10, 12(1), and 13 of the Constitution, the Centre for Policy Alternatives (CPA) mentioned on their official Twitter account. The Tweet also mentioned that the Supreme Court has issued an interim stay order preventing the operation of the controversial regulations, as well as any amendment or alteration to them, until the case’s conclusion. The hearing of the case has accordingly been fixed for 21 and 23 March 2022. The CPA and its Executive Director, Dr. Paikiasothy Saravanamuttu, filed papers challenging the Prevention of Terrorism (De-radicalisation from holding violent extremist religious ideology) Regulations No. 01 of 2021, published Extraordinary Gazette No. 2218/68 dated Friday, 12 March 2021. While the Petitioners maintain the need to integrate a process of rehabilitation into the criminal justice system, they note that the impugned regulations violate several of the Constitutionally-guaranteed Fundamental Rights of the Petitioners, as well as of the general public.
