DUI, reckless driving: Action under both criminal law and traffic law

The Deputy Inspector General of Police (DIG) in charge of Traffic Control and Road Safety, W.P.J. Senadheera has stated that motorists found driving under the influence (DUI) of alcohol or engaging in reckless driving will face action under criminal law in addition to traffic regulations. He warned that strict action would be taken against reckless drivers, including the imposition of severe penalties under criminal law in addition to the existing traffic regulations.

Addressing a media briefing yesterday (29), DIG Senadheera said that the number of road accidents this year (2025) has increased compared to last year (2024). “Compared to last year, road accidents have increased by 271 this year, with deaths rising by 317.”

Pointing out that DUI of alcohol is a major factor behind these accidents, he added  the Inspector General of Police (IGP) has instructed them to take action under the criminal law in addition to enforcing traffic laws for such incidents in the future. “In future, the IGP has instructed that in addition to traffic law enforcement, action will also be taken under the criminal law against drunk and reckless driving,” he added. He further noted the IGP has already issued directives to all Police stations in this regard.

“However, serious accidents have generally decreased. The main cause of the increase is driver negligence and carelessness, which has had a significant impact,” DIG Senadheera said.

He further noted that pedestrians are the most affected, with 31% of road accidents involving pedestrians, followed by motorcyclists, pillion riders, and three-wheeler drivers. DUI of alcohol is a leading factor in accidents caused by motorists, he further added. 

Police have confirmed an increase in road accidents this year compared to 2024, with the use of drugs and alcohol identified as a primary contributing factor.

Meanwhile, journalists at the media briefing in Colombo at which Senadheera spoke raised questions regarding the conduct of investigations into the recent road accident involving Parliamentarian Asoka Ranwala. In response, DIG Senadheera acknowledged the relevant officers had failed to carry out their duties appropriately and confirmed that an investigation into the incident is currently underway.
