DIG Nalaka charged under PTA, no reference to murder plot

By Mandana Ismail Abeywickrema Former head of the Terrorism Investigations Division (TID) DIG Nalaka de Silva has been charged under the Prevention of Terrorism Act (PTA). De Silva's counsel, Ajith Pathirana told The Sunday Morning that the DIG has been accused by the Criminal Investigations Department (CID) of violating Sections 100 and 109 of the Penal Code as well as Section 2 Sub section (h) of the PTA. The relevant PTA section deals with an individual's alleged involvement in causing communal disharmony. According to the counsel, there has not been any reference to de Silva's alleged involvement in a plot to assassinate the President or several opposition VIPs. Pathirana explained that de Silva has been taken into custody under two pieces of evidence - the complainant's statement and the Government Analyst's report. The counsel charged that while there are discrepancies in the complainant's statement, the Government Analyst's report states that a software called audio cutter had been used on the voice recordings. "Also, the dates saved in the recording notes they were recorded in 2018 when they were supposed to be from a year earlier," Pathirana said. De Silva was taken into custody last night after a combined 56 hours interrogation and produced before the Fort Magistrate who remanded him till November 7th.
