- Five vacancies in Court of Appeal
The Bar Association of Sri Lanka (BASL) has raised concerns regarding the prolonged delay in appointing judges to fill vacancies in the Court of Appeal.
In a letter addressed to President Ranil Wickremesinghe, the BASL emphasised on this grave issue, stating that there were as many as five Court of Appeal vacancies at present.
“The Judiciary plays a pivotal role in upholding the rule of law, enforcing justice, and safeguarding the rights of all citizens. However, the efficiency and effectiveness of the judicial system are significantly hampered when key positions remain vacant for extended periods,” the letter stated.
It further highlighted the issues faced due to these vacancies, such as the increase in the backlog of cases, the delay in the dispensation of justice, the erosion of public trust in the legal system, and ultimately, the denial of justice to the citizens of Sri Lanka.
“This could, in addition, further reduce Sri Lanka’s Ease of Doing Business ratings, which will in turn hamper economic recovery efforts,” it said.
The letter added that the absence of a full bench in the superior courts diminished the diversity of perspective and expertise, identified as being crucial for comprehensive and balanced adjudication.
While acknowledging the complexity and the importance of the appointment process, the BASL emphasised on the need to ensure that the prevailing situation did not continue and requested the President to treat this matter with utmost priority.
Dated 10 May, the letter, signed by BASL President Kaushalya Nawaratne and Secretary Chathura A. Galhena, further expressed hope for an expeditious and favourable response regarding the matter.
