5-Judge Court of Appeal bench to hear Judges’ PAYE issue

  • Grants leave to writs filed by HC/DC Judges, Magistrates 



The Court of Appeal has granted leave to consider two writ applications seeking an order revoking the decision to impose the Pay As You Earn (PAYE) tax on the salaries of Judges.

Accordingly, these two petitions, filed by the High Court (HC) Judges’ Association and the Judicial Officers’ Association, will be called before a five-Judge bench of the Court for consideration.

Meanwhile, the interim order preventing the imposing of the PAYE tax on the salaries of Judges was further extended until 22 March.

These orders were given by the bench comprising the Court’s President, Justice Nissanka Bandula Karunaratne and Justice A. Marikkar yesterday (16) when a petition filed by District Judges and Magistrates was taken up.

This petition will be called again on 22 March.

The Court first issued the interim order on 25 January, preventing the Inland Revenue Department from collecting PAYE taxes from Judges following the consideration of a petition filed by an association of District Judges and Magistrates.
