Zuckerberg’s neural trap on trial

Soon after Adam Mosseri, who oversees Instagram, testified about the platform’s design and safety features, the owner of the company, Meta, that runs these applications – including Facebook – Mark Zuckerberg, took the stand last Wednesday (18) to defend himself. 

This is one of the most consequential litigations against the technological apparatus of our era, not merely for its scale but for what it exposes about the deliberate engineering of human attention. The case challenges the very assumptions underpinning social connectivity in the 21st century – that platforms which claim to connect humanity may instead be exploiting and reshaping it in ways that are neither accidental nor benign. 

Over the years, Zuckerberg has publicly portrayed these platforms as instruments of utility and human betterment, asserting that the guiding principle was value and meaningful engagement. 

Internal documentation, however, tells a markedly different story: strategies explicitly targeted the prolongation of engagement, particularly among minors, knowing full well the neurological vulnerabilities of developing brains. Children under 13 were knowingly exposed to these systems, circumventing official safeguards, while internal metrics monitored their every swipe and scroll.


A moral exposure


The Zuckerberg trial is not merely a legal confrontation; it is a moral exposure, revealing the asymmetry of power between a platform and its users. 

As John Rawls wrote in ‘A Theory of Justice,’ “Justice is the first virtue of social institutions, as truth is of systems of thought,” reminding us that institutions – digital or otherwise – bear a primary responsibility to safeguard the vulnerable. Yet here, the vulnerable are systematically exposed to manipulations of attention and cognition, their neurodevelopment treated as a tool for profit rather than a public trust. 

Franz Kafka’s ‘The Trial’ provides a haunting mirror: “It is only because of their guilt that they are permitted to exist,” capturing the Kafkaesque reality in which ordinary users, especially children, are caught in algorithmic machinery beyond comprehension, endlessly judged by opaque systems designed to extract value from their engagement.

The consequences of this engineered immersion are not theoretical. Studies show that compulsive engagement can alter cognitive processing, disrupt attention allocation, and exacerbate anxiety, depressive tendencies, and maladaptive behaviours in adolescents. 

The human brain did not evolve to withstand unremitting novelty and constant dopamine reinforcement delivered via algorithmic stimuli. Richard Cytowic, a neurologist at the George Washington University, last week described this as the collapse of attentional bandwidth, a “tyranny” in which the cognitive load imposed by continual notifications, variable rewards, and algorithmically amplified stimuli overwhelms neural processing, leaving working memory depleted and executive function impaired. 

Meta and its contemporaries, such as YouTube including its Reels, and TikTok, have constructed not tools, but psychological traps: Frankensteinian architectures that exploit the very substrates of attention, memory, and desire, turning the human psyche into a revenue stream.

Zuckerberg’s public statements over the years now appear increasingly dissonant against the documentary evidence. He has claimed repeatedly that Meta’s mission is to create utility, to build connections, and to foster beneficial social ecosystems. Yet internal slides, particularly from 2017, show goals that placed quantitative engagement above any qualitative metric, explicitly focusing on ‘time spent’ by teenagers, including those who circumvented the under 13 restriction. 

The rhetoric of value has masked the pursuit of monetisable attention, where the neural architecture of minors is leveraged as an asset class. These applications are not passive intermediaries but active agents in shaping cognition and behaviour. The question is no longer whether social media is a tool; it is whether it is a technological predator, programmed to exploit neurodevelopmental susceptibilities for profit.


Exposing a shadow economy


The trial exposes the shadow economy of attention harvesting. Meta executives understood, long before the public, the risks imposed by their platforms: exacerbation of anxiety, reinforcement of body image distortions, cyberbullying, and compulsive behaviours. Yet the company publicly denied or minimised these harms, maintaining a narrative of neutrality and benevolence. 

When confronted with internal documents that revealed millions of underage accounts and engagement-maximising strategies, Zuckerberg attempted to reframe historical objectives as mere experimentation with utility. The gulf between public representation and internal practice is neither trivial nor accidental; it is the foundation of a systemic manipulation, a deliberate commodification of human cognition.

The technological design choices in question are profound in their implications. Infinite scroll, emotional reactions, variable reward schedules, ephemeral notifications, algorithmic content curation – these are not neutral features. They are carefully calibrated mechanisms that interface directly with dopaminergic pathways, eliciting behavioural patterns analogous to addiction. 

Behavioural neuroscience demonstrates that intermittent reinforcement, unpredictability of reward, and frequent novel stimuli hijack attention and impair self-regulation. This is not mere inconvenience; it is a material intrusion on cognitive architecture. 

Children and adolescents are particularly susceptible because prefrontal cortical regions responsible for impulse control and long-term planning remain underdeveloped. Meta’s internal awareness of these vulnerabilities, paired with the pursuit of monetised engagement, positions the company as a deliberate manipulator of immature neural systems.

The social ramifications extend far beyond individual harm. Cognitive overload, attentional fragmentation, and the restructuring of neural priorities are reshaping social interaction itself. Peer relationships, educational engagement, emotional regulation, and even familial cohesion are all increasingly mediated by platforms designed to maximise micro-moments of reward. The consequences are cumulative: diminished attention spans, pervasive anxiety, sleep disruption, and an erosion of reflective thought. 

Social media, in its current configuration, functions as both amplifier and accelerant of cognitive entropy, a Frankenstein’s construct whose unintended consequences – though predictable by internal research – have been obscured from the public until now.


A groundbreaking trial


Legally, the implications are seismic. Section 230 of the Communications Decency Act (CDA) of 1996, a US federal law, has insulated platforms from liability for user-generated content, but it does not absolve companies from culpability arising from the architecture itself. The court is now interrogating whether design choices constitute active exploitation rather than passive facilitation. 

A precedent in this case could redefine the legal landscape for the entire technology sector, forcing corporations to consider not only privacy and safety but the neurological and psychological consequences of every interface element. Monetisation strategies that prioritise engagement over well-being may no longer be insulated from judicial scrutiny, with ripple effects that could alter business models, regulatory oversight, and the ethical calculus of product development.

Zuckerberg’s defence, and the defence mounted by Meta more broadly, relies heavily on the argument that the scientific link between social media use and mental health outcomes is not conclusively established. While causality in complex social phenomena is always challenging to prove, internal research and user data demonstrate correlations between engagement-maximising features and adverse outcomes. 

These correlations, when coupled with intentional design choices and internal acknowledgement of risk, present a compelling ethical question: can a platform continue to prioritise profit when the predictable consequence is neurological disruption and social harm? It is the central question of the trial and, potentially, of the future of social media itself.

The trial also highlights the performative missteps of Meta leadership. Observers noted that Meta representatives wore camera-equipped devices inside a courtroom where recording was explicitly forbidden. 

This act, whether inadvertent or negligent, symbolises the dissonance between corporate culture and accountability. A company that designs pervasive surveillance and engagement tools yet struggles with basic compliance in legal oversight reflects a systemic hubris that has long underpinned its operational philosophy.

However, if the plaintiffs succeed, this could catalyse a fundamental restructuring of social media design, regulation, and corporate accountability. Algorithmic features may need to be restricted, transparency requirements imposed, and age-specific safeguards enforced. 

Conversely, if the case fails, the precedent will signal tacit permission for corporations to continue designing compulsive attention systems, insulating themselves behind legal protections while harvesting the most intimate resource humans possess: focus itself.
