SJB files petition before SC against Muthurajawela acquisition

The Samagi Jana Balawegaya (SJB) filed a petition before the Supreme Court today, against the extraordinary gazette released on 7 October 2021 allowing the Urban Development Authority (UDA) to acquire the Muthurajawela marshland stretching from Peliyagoda to Negombo. Petitioners include SJB MP Kavinda Heshan Jayawardana and Kurukulasooriya Sebastian Newman Fernando. The petition was filed by President's Counsel Farman Cassim. 14 respondents have been named, including Prime Minister Mahinda Rajapaksa, Ministers Nalaka Godahewa and C.B. Rathnayake, along with the Attorney General’s department. The Court has been requested to declare that the Fundamental Rights of the Petitioners and/or of the general public of the area guaranteed under Article 12(1) and/or Article 14(1) (g) and/or 14(1)(h) of the Constitution have been infringed upon and called for the nullification of the purported Gazette. “We will be filing a writ petition at the SC regarding this gazette, as it completely violates the fundamental rights of families who have been living in this area for generations. We also eventually hope to file a fundamental rights (FR) petition regarding the matter,” SJB Parliamentarian Dr. Kavinda Jayawardana told The Morning yesterday (4).
